PARTIES AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF CONTRACTING:

On the one hand, the provider of the products, ALONSO ASSOCIATES EFECTIVE MARKETING SL (hereinafter also the provider), with tax address at CALLE AARÓN VIDAL, NUM 6 PUERTA E, 46026 VALÈNCIA, CIF (Tax ID): B22777155 and e-mail: pedidos@helliot-bikes.eu, being the owner of the website www.helliot-bikes.eu, sets forth the contractual document that will govern the contracting of products through the aforementioned website.

And on the other hand, the User – Client (hereinafter the User), registered on the website by means of a username and password, for which they have full responsibility for use and custody, being responsible for the veracity of the personal data provided to the provider.

BOTH PARTIES ACCEPT this document, which implies that the user:

  • Has read, understands, and comprehends what is set forth herein.
  • Is of legal age and has sufficient capacity to contract.
  • Assumes all the obligations set forth herein.
  • Has read and accepts these general purchasing conditions from the moment any product offered is acquired.

This document can be printed and stored by the Users.

The provider makes the e-mail address pedidos@helliot-bikes.eu available to them to raise any questions about these conditions.

These conditions will have an indefinite period of validity and will be applicable to all contracts made through the provider’s website.

The provider reserves the right to unilaterally modify said General Conditions, without this affecting the goods or promotions that were acquired prior to the modification, in order to improve the products offered. In any case, these general conditions must be consulted before purchasing the products.

It is advisable to keep a copy of the data contained in the purchased products.

ALONSO ASSOCIATES EFECTIVE MARKETING SL is not responsible for any loss of data, files, or any damage resulting from a backup failure by the User of the data contained in the acquired products, such as memory cards.

ALONSO ASSOCIATES EFECTIVE MARKETING SL is not responsible for the consequences that may result from improper use of the products for sale on the web.

The civil liability of ALONSO ASSOCIATES EFECTIVE MARKETING SL for the products supplied is limited to the amount of the same; the user renounces claiming any liability from the provider for any concept in any case of dissatisfaction with the products acquired on the website www.helliot-bikes.eu, as well as possible failures, slow access, or errors in accessing the web, including loss of data or other information that may exist on the user’s computer or network accessing the web.

ALONSO ASSOCIATES EFECTIVE MARKETING SL is a company specialized in the distance selling of SPORTS products. ALONSO ASSOCIATES EFECTIVE MARKETING SL sells its products at a distance over the Internet through its website and/or by telephone.

OBJECT OF THE CONTRACT:

2.1 Scope of application: The purpose of this contract is to regulate the contractual sales relationship born between the provider and the user at the moment the latter accepts these purchasing conditions during the online contracting process by checking the corresponding box. These GTC will apply from the day the order is placed. The contractual sales relationship entails the delivery, in exchange for a determined price publicly displayed through the website, of a specific product.

2.2 Territory of application: The virtual store at www.helliot-bikes.eu is active for all of Spain.

2.3 Capacity to contract: To place an order, you must be of legal age and have the capacity to contract.

2.4 Customer acceptance: The validation of an order through the website www.helliot-bikes.eu is done by email and also implies the automatic acceptance of the GTC. These conditions are available on the website www.helliot-bikes.eu or, if you wish and request it, we can make them available to you by email.

2.5. Modification of the General Terms and Conditions of Contracting: ALONSO ASSOCIATES EFECTIVE MARKETING SL reserves the right to make changes and/or modifications to these GTC. We advise our clients to review them regularly. In the event that these changes or modifications are introduced after an order has been placed, the conditions in force on the date the order was placed will apply.

INFORMATION PROVIDED ON THE WEBSITE www.helliot-bikes.eu:

3.1 Publication of prices: Exceptionally, the prices of the products shown on our website may be specified incorrectly and show a price lower than the corresponding one. When this happens, and if we have confirmed your order, we will contact you immediately to issue a new order confirmation with the correct price. In the event that the corresponding price is higher, you may cancel your order and we will refund any amount you have already paid.

3.2 Product information: The information contained in our advertising, brochures, other written material, on our website, or provided by our agents or employees constitutes an invitation to treat. This information does not constitute an offer to supply any product on our part. The contents of www.helliot-bikes.eu are constantly being renewed and updated to offer our clients the most complete and detailed information possible. Because of this, it is possible that the contents may, on exceptional occasions, show provisional information about some products. In the event that the information provided does not correspond to the product’s characteristics, the client will have the right to rescind their purchase at no cost on their part. All contractual information present on the website is displayed in Spanish (Castilian) and communication with clients and users, as well as the formalization of the contract, will be carried out in this language, although, if the client so wishes, it can be done in another language, provided it is indicated before starting the contracting procedure.

3.3 Availability of the product(s): There may be occasions when it is impossible to supply all the products because they are not in stock or available at the time of purchase. In these cases, we will contact you to give you a choice between the following options:

a) choosing an alternative product, with similar characteristics to the product to be replaced; b) communicating its availability, in case you prefer to wait for said product to be available in the store again. If you decline our suggestions, the order related to these products will be canceled and any sum you had paid for them will be refunded.

3.4 Right of Cancellation: ALONSO ASSOCIATES EFECTIVE MARKETING SL reserves this action (right of cancellation) for the shipment of a specific product that does not meet the quality requirements imposed on all products at www.helliot-bikes.eu. In the event that this lack of quality is detected, the Customer Service of ALONSO ASSOCIATES EFECTIVE MARKETING SL will suggest a replacement product and, if the replacement is not to the client’s liking, the cost of said product will be refunded.

3.5 Orders 24h, every day of the year: The order reception schedule is twenty-four (24) hours, three hundred and sixty-five (365) days a year, although orders placed after 7:00 p.m. (19:00) will not be processed, being left for the next business day in València. Orders received during the weekend will be processed first thing on the following Monday, or the first business day.

3.6 Fraud: If ALONSO ASSOCIATES EFECTIVE MARKETING SL suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

PURCHASE PROCEDURE:

To access the products offered by the provider, the user must register through the website by creating a user account. The user may not choose as a username words that are intended to confuse others by identifying the user as an integral member of the provider, as well as offensive, injurious expressions and, in general, those contrary to the law or to the requirements of morality and good customs.

Once the user account has been created, it is reported that in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow these steps:

  1. Choose the product by clicking on it, and it will be automatically added to the “shopping cart”.
  2. If you wish to add more products, you must select the “Continue shopping” option. If you have mistakenly added one you did not want, you must click on the option to remove it from the shopping cart. In the shopping cart, you will see the items, quantity, price, and total amount.   4.   6. Once registered, an observations screen will appear, where you can indicate the delivery time; a checkbox that must be marked as it is the acceptance of these General Terms and Conditions of Contracting and the Privacy Policy.

In any case, the provider’s contracting platform will inform the user, once the contracting procedure is finished, via email regarding all the characteristics, price, transport methods, contracting date, and estimated delivery of the purchased product.

If there is any type of error in the address indicated or in any other point of the order, you must notify it immediately to the e-mail address that will appear on the web to proceed with the correction of this error.

ALONSO ASSOCIATES EFECTIVE MARKETING SL will provide Customer Service FREE of charge through our contact email pedidos@helliot-bikes.eu. If you choose another alternative means of communication, the user must bear the particular cost of it.

PURCHASE AS A GUEST

This website also allows purchases through the guest purchase functionality. In this purchase mode, you will only be asked for the essential data to process your order. Once the purchase process is finished, you will be offered the possibility of registering as a user or continuing as an unregistered user.

SHIPPING:

Shipments will be made through the company Seur, whose Customer Service telephone number is 902 10 10 10. Shipping costs will be applied as follows:

The delivery time is usually between 1-2 working days, depending on the destination and the chosen payment method. This term is understood provided that the availability of the merchandise has been confirmed and the full payment of the order has been verified.

The Provider will not assume any responsibility when the delivery of the product or service does not take place because the data provided by the user is false, inaccurate, or incomplete.

Delivery will be considered made at the time the carrier has made the products available to the user and the user, or their delegate, has signed the delivery receipt document.

It is the User’s responsibility to verify the products upon receipt and to state all reservations and claims that may be justified in the delivery receipt document.

In the event that the contract does not involve the physical delivery of any product, these being directly downloaded from the website, the provider will inform the user in advance about the procedure to follow to perform this download.

The Seller assumes no responsibility when the delivery of the Product does not occur as a result of the data provided being false, inaccurate, or incomplete, or when the delivery cannot be made for reasons beyond the Seller’s control, such as the absence of the recipient or retention of the shipment at customs. In no case shall this delay entail the obligation to pay any compensation.

PRICES AND VALIDITY PERIOD OF OFFERS:

All prices displayed in the www.helliot-bikes.eu store include the VAT in force at the time of purchase. All prices on the website are valid except for typographical errors or until stocks last, and in any case, they will be expressed in the Euro (€) currency. Said costs, unless expressly indicated otherwise, do not include shipping, handling, packaging, shipping insurance, or any other additional services and annexes to the product or service acquired. (VALUE ADDED TAX: In accordance with the provisions of Article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of products or services will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory).

The payment made to the provider will entail the issuance of an invoice in the name of the registered user. This invoice will be automatically sent to the email address provided by the user, as well as sent with the purchased product.

The prices applicable to each product will be those published on the website and applied automatically by the contracting process in its last phase. The client assumes that, in any case, the economic valuation of some of the products may vary in real time. In any case, this will always be communicated in advance to the users.

In the case of limited-duration promotions, the promotion discount will be applied as long as the order has been registered during the promotion period.

The data recorded by the different payment methods constitute proof of the date on which the financial transactions were carried out and will serve to determine whether said order is subject to promotion.

PAYMENT METHODS:

Below we detail the available systems:

7.1 Payment by credit or debit card: The user must have a valid credit or debit card, where they must specify all the digits of the card number in the corresponding form. The operation is formalized at the time of placing the order. Only payments with secure cards are accepted, in which your identity as the cardholder is authenticated according to the method established by your bank, through secure electronic commerce. The order cannot be taken into account and will not be processed until the payment has been authorized by your bank or savings bank. The SSL (Secure Sockets Layer) system is used, a payment system in a secure environment as it allows the encryption of information transmitted during the transaction, ensuring its confidentiality.

7.2 Payment by bank transfer or account deposit: Upon finalizing the order, the user will receive instructions with the account number to pay for the order. It is essential to clearly indicate the assigned order number and the user’s name in the transfer order. To confirm the order, it will be necessary to make the transfer within 7 days; otherwise, it will be canceled in our system.

ORDER DELIVERY:

8.1 Shipping Address: The delivery of orders will be made to the delivery address freely designated by the user. In this way, the provider assumes no responsibility for when the product delivery does not occur as a result of the data provided by the user being false, inaccurate, or incomplete, or when the delivery cannot be made for reasons beyond the control of the shipping company, assigned for this purpose, such as the absence of the recipient. The order delivery time will be during regular business hours. Without prejudice to the foregoing, the provider has adopted the measures required of a diligent merchant so that the delivery can be made in the agreed time, so no liability can be attributed to the provider. Free shipping is only available for destinations in Peninsular Spain. For the Balearic Islands, Canary Islands, Ceuta, and Melilla, there is an extra charge. ALONSO ASSOCIATES EFECTIVE MARKETING SL will use all means at its disposal so that your order is delivered within the period specified on our website on the date of the order confirmation.

8.2 Delivery times: These correspond to those set on each product’s page. In the case of products not available at the time of purchase, our Customer Service can provide you with availability information and a delivery time. If you have requested several products in the same order, keep in mind that they may have different availability dates, in which case you may receive them on different dates. 8.3 Shipping confirmation: At the time the order is handed over to our carrier, we will send you a shipping confirmation to the email address you provided when placing the order. In the shipping confirmation, we will indicate the corresponding tracking number so you can track it through our carrier’s website.

8.4 Damage on delivery: Products are inspected in the warehouse before leaving, delivered in secure packaging. If at the time of delivery it is visibly noticeable that the box or product has defects caused by transport damage, or if an error in the received merchandise is noted in the same way, the customer must detail this fact on the “delivery note” signed for the carrier and contact our Customer Service line 676949985 or email “incidencias@helliot-bikes.eu” within 24 hours of receiving the merchandise. A delivery note without any damage noted is equivalent to a product with the packaging in perfect condition. Likewise, if damage to the product is detected after opening the package, with the packaging in perfect condition, the customer has 24 hours from receipt to contact our Customer Service line 676949985 or email “incidencias@helliot-bikes.eu“. After 24 hours from delivery, claims for product damage will not be accepted.

9. EXCHANGES AND CANCELLATIONS

For an exchange, cancellation, or return of your order, contact incidencias@helliot-bikes.eu; we will help you and indicate how to do it.

Returns

In accordance with Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users, and with Law 7/1996 on Retail Trade Regulation, if for any reason you are not satisfied with your order, you have the right of withdrawal from the purchase within a period of 14 days. This means that you can voluntarily return your product within 14 calendar days after receiving it. This right can be exercised on one of the products, on several, or on the entire order.

You must notify this by email to incidencias@helliot-bikes.eu, indicating your full name and order number. Our incident manager will indicate the corresponding procedure and will send you the relevant withdrawal document, which you must send together with the product.

For the return of the product, we recommend that it be done through the same transport agency that delivered it. The refund of the amount will be made in the same way as the payment, deducting the shipping costs.

To return a product, you must know that:

  • The product must be in perfect condition and in its original packaging.
  • The product(s) cannot have been assembled, tested, tampered with, etc.
  • Helliot Bikes is not responsible for improper assembly by the customer. This means that if a customer receives components to assemble a product and, when assembling it, does not do so carefully or with the appropriate tools, the components may be scratched, stripped, or worn. The customer is responsible for improper assembly, and in this case, a return/withdrawal will not be accepted.
  • Outlet bicycles are new, either with damaged packaging or because they have been assembled and disassembled for various reasons: exhibition, product testing, advertising… They are in perfect working order. They may contain, though not all, some minor aesthetic defect.
  • In the case of reconditioned bicycles, which come from returns, they may contain some blemish or defect, which will be indicated in the description. It is important that if you have any doubts, you contact us via phone, WhatsApp, email…

REFUNDS:

ALONSO ASSOCIATES EFECTIVE MARKETING SL will not refund the amount or reship any merchandise until the reception and condition of the packaging and accessories of the product being returned or exchanged have been verified in our warehouse.

The refund will be made within 15 business days from the receipt and verification of the conditions of the shipment’s reception. The maximum established period to make the payment is one month. To proceed with the refund, you must provide us with the following data:

  • IBAN + 20 digits of your bank account

WARRANTY

Royal Legislative Decree 1/2007 of November 16 grants durable goods a legal warranty of 2 years from the delivery date. The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.

Deficiencies caused by negligence, blows, improper use, or manipulation are not included.

NULLITY AND INEFFECTIVENESS OF THE CLAUSES:

If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, with the General Conditions remaining in all other respects, and such provision, or the part of it that is affected, being considered as not included.

APPLICABLE LAW AND JURISDICTION:

These conditions will be governed or interpreted in accordance with Spanish legislation in everything that is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the products or services object of these Conditions to the Courts and Tribunals of the provider’s domicile (if a legal entity) or the user’s (if a natural person).

In the event that the user is domiciled outside of Spain, the provider and the user expressly waive any other forum, submitting to the Courts and Tribunals of the city of València (Spain).
